HIGH COURT IN LILONGWE DISMISSES COMPENSATION CLAIMS WITH COSTS

On 14th January, 2019, the High Court in Lilongwe dismissed compensation claims in Civil case number 779 of 2014 between Greselder Jeffrey, Brian Kachingwe, Agnes Kaphikire representing Philip Kaphikire (deceased) and Tadala Chakhaza representing Brighton Chakhaza (deceased) and the Bureau. The first two sued the Bureau for malicious prosecution, false imprisonment, defamation, breach of contract and loss of business with legal costs.

Agnes Kaphikire and Tadala Chakhaza sued the Bureau for malicious prosecution, false imprisonment and loss of dependency with legal costs.

The ACB has successfully, defended the case and prevented the loss of tax payers’ money in excess of MK50 billion through the claims for compensation. The legal suit was in relation to the case related to construction of school blocks which the Bureau investigated and prosecuted in the late 90s and early 2000.
